In the following terms & conditions “the photographer” shall mean Emma Lane trading as Poutfit Parties. “The client(s)” shall be those persons defined on the booking form or the persons defined on the order form. These terms & conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.
The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.
If you do not wish for your photos to be used via social media then please let us know.
3. LICENSE, COVERAGE AND REPRODUCTION:
Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.
Please allow 28 days for delivery of reprints ordered online.
Delivery time for prints, albums and books etc can vary and the photographer will advise regarding this as accurately as possible at time of ordering. However the client indemnifies the photographer against any liability caused due to delays resulting from unforeseen problems with suppliers.
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow being copied photographically/electronically or by any other means an image created as part of this contract without the permission of the photographer in writing. Any breaking of seals in the viewing album will presume a breach of copyright. The photographer may display samples of this order.
Deposit of £50 to be paid for all parties with completed booking form to secure booking then outstanding balance to be paid 1 week before party date

5. FORCE MAJEURE:
The photographer will endeavor to put the client(s) in touch with another photographer in the event they are unable to attend due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.
In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.
All digital negatives (computer files) remain the property of the photographer.
7. CANCELLATION FEES:
If you cancel 5 weeks before the party date we are happy to hold your deposit if you reschedule within the next 2 months otherwise its non refundable. If you cancel 2 weeks before the party date then full payment is required. But we are happy to hold your payment/booking if you reschedule within the next 2 months.
8. AT THE EVENT:
All Parties are 2 hours unless stated otherwise.
One outfit per girls with mini make over.
One outfit per girl for model make over.
Total no. of guests includes birthday girl or boy.
Please allow 15 minutes setting up time each side of your party
No Food and drink aloud accept birthday cake and bottled water.
Strictly no photos are to be taken whilst the photographer is shooting
We reserve the right to change party and extra service descriptions without prior notice.
Please let us know in advance if there are any girls with Afro Caribbean hair.
Please supply us with each parents contact details on booking form.
All make up and face-painting forms must be signed by each parent to give permission for their child to have the treatment.
Please note that we do our best to provide the party bags as described, but from time to time certain items may be unavailable and therefore replaced with another item of similar value.
You must notify us in writing or email if any guests cannot receive any of the treatments for any reason. We are not responsible for any adverse reaction to treatment.
9. PERSONAL ACCIDENT:
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
Any complaints should be raised by the client with the photographer, in writing within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
